Access to the JIST Gateway site is restricted to the purchaser of an assessment activation code and their designated affiliates, customers, and users. Activation codes and subsequent user attempts are valid for one year from the date of original purchase from JIST Publishing. Using the original activation code, all completed assessment results are available on the Gateway site for two years from the date of the attempt.
JIST Publishing may terminate your use of the Site at any time and for any reason, with or without cause, without prior notice to you, and without any liability or further obligation of any kind whatsoever to you or any other party. JIST Publishing also reserves the right to use any technological, legal, operational, or other means available to enforce the terms of this Agreement, including without limitation, blocking specific IP addresses.
JIST Publishing reserves the right, at any time and for any reason in its sole discretion, to change, modify, amend, and/or update the terms of this Agreement. Whenever a change is made the new Agreement will be posted on the Site. Therefore, you should review this Agreement before using the Site. Your use of the Site after the new terms are posted will signify your agreement to be bound by the new terms.
You may not modify, copy, distribute, republish, commercially exploit, or upload any of the material on the Site without the prior written consent of JIST Publishing, Inc. You may not distribute (including via email or the Internet) any content from the Site, or otherwise make available, copies to others, whether or not for payment or other consideration, without written permission from JIST Publishing.
This Site is located in the United States, and this Agreement and the interpretation of this Agreement will be governed by and construed under the laws of the United States and the State of Minnesota, without regard to conflict of law principles. You agree and submit to the exclusive and mandatory jurisdiction and venue of the State and Federal Courts situated in Ramsey County, Minnesota and agree you will not object to such jurisdiction or venue on the grounds of lack of personal jurisdiction, or otherwise. Any cause of action or claim arising out of this Agreement or your use of the Site, regardless of form or the basis of the claim, must be brought within one (1) year after the cause of action arose or, if multiple causes, from the date the first such cause of action arose.

The information you provide for your account with JIST Publishing, Inc. is used solely for fulfillment of your order, and to contact you about your purchases. Your account information is not shared with companies or sold to any organizations outside of New Mountain Learning; other than the registered facilitator(s) at the intuition responsible for administering and documenting your participation in our assessment and eWorkbook systems.
